Thank you, Mr. Chair. There is a counterpart regulation-making authority with respect to section 51. If it is okay to note it, it is 111(1)(u), and the language there is "respecting requirements in respect of measures." That provides benefits to the people of the Northwest Territories. "Requirements in respect of measures" could include a series of things, but there are no more particulars that indicate that penalties would flow from parts of that "requirements with respect to measures." Thank you, Mr. Chair. The definition of "settlement area" that was just inserted, replaced a definition of "settlement lands." The settlement lands terminology, it can be found in the bill, and it has been replaced with a definition for settlement area. I understand we can't speak to matters that come, but I understand that there are adjustments that are made flowing out of that change. In that case, settlement area will be referred to in multiple provisions. Now, the Member could look to where it says "settlement lands" and anticipate a settlement area. Thank you, Mr. Chair.

Thank you, Madam Chair. The regulation-making authority at Section 63.1(k) references the ability to prescribe fees to be paid for the right to use water or deposit of water, filing of application and for inspections. If I could add another note respecting the public register in addition to Mr. Fulford’s, I believe the section that was referenced is 53(3), and in that section it speaks to making copies of the contents available on payment of a fee, which might be of assistance in answering the question.

Thank you, Madam Chair. In this case, we actually kept the imperial measurement because a conversion would have created a decimal number. Without having the opportunity to review exactly the implications of rounding that decimal number, it was determined as an interim measure to keep it as is. Then in the future we could look at these sorts of instances and make them conform with our practice, which is a metric measurement. Thank you, Madam Chair.

In my effort to summarize, I lost the precision that I had intended to convey. There needs to be at least one member from the area that’s described in an appendix to the Gwich’in Agreement, one in respect of the Inuvialuit Settlement Region, and the area described in the Sahtu Agreement, and the area described in the Tlicho Agreement.

Thank you, Madam Chair. The mirroring of the legislation was done in strict terms, so the federal legislation that is mirrored here did not include a review clause in it in this particular case or in any other case. So, in executing the substantial mirroring requirement of the Devolution Agreement, no provisions were inserted that were not required to address the implementation of the legislation in the territorial context. So, a provision such as a review provision was not inserted at that time. Thank you.

Clause 11 of the bill sets out qualifications and residency requirements respecting the composition of the board, starting with a requirement that members and alternate members have knowledge and experience that will assist the board in fulfilling the obligations under the act, and then among the members of the board will be specific appointees from certain regions.

The home in this context, I believe, would take the regular meaning of the place where the person resides day to day, and the word home is used in the context of the definition “principal residence,” so it’s the usual place where the Member makes his or her home at the time of his or her election as a Member.

Thank you, Madam Chair. The Member noted the bill is structured so that it relates to the Sahtu community, and lists the specific communities to which this provision applies and it’s triggered by the Sahtu communities in this particular bill.
